Please read our kitten contract.  Our contract spells out what is covered with regards to our written health guarantee.  Please read our contract and ask any questions you may have, you will be required to sign and agree to the terms contained within the agreement.

 

Adoption Contract for Pet Kitten

 

This agreement is made and entered into between XXXXXXXX, also known Rocky Mountain Persians & Exotics Cattery, hereinafter known as "Breeder",  and ________________, hereinafter known as "Adopter".

Breeder agrees to sell and Adopter agrees to buy one purebred Exotic Shorthair described as follows:

  1. The adoption fee is $________, with the following conditions: All rights and responsibilities of ownership is the sole responsibility of Adopter (including, but not limited to all transportation costs, spay or neuter and all veterinary costs).

 

  1. This kitten is purebred and registerable with the Cat Fancier’s Association (CFA). Adopter shall have kitten spayed or neutered prior to Date (eight months of age). Once the adopter has provided the Breeder with proof of alter, the breeder shall provide the documentation to register the kitten with the Cat Fancier’s Association. The proof of alter can be the receipt from the veterinarian. If the Breeder does not receive confirmation of spay or neuter, CFA registration documents shall be withheld indefinitely. To reiterate, this kitten is not to be used for breeding which is considered a breach of contract and all health guarantees become null and void if breeding has occurred, including accidental / unintended breeding.

 

  1. Breeder warrants that the above-described kitten is in good health at the time Adopter assumes possession. However, it is recommended that Adopter have the kitten examined by a licensed veterinarian within 48 hours of receipt of kitten (not including weekends and holidays). If the veterinarian determines that the kitten is not in good health, then Adopter must notify the breeder and may return the kitten to the Breeder for a replacement of like quality and breed standard. Return of the kitten will be at Adopter's expense. Written verification by the veterinarian of any disease found must be presented to the Breeder upon return of the kitten. After 48 hours from purchase (not including weekends and holidays), Adopter assumes full responsibility for the kitten's health and development, including, but not limited to, all veterinarian expenses.

As stated above, this kitten is being sold as a pet quality with a spay /neuter contract. Therefore, this kitten may exhibit one or more faults which in no way diminishes its value of being a pet quality kitten.  These faults may include, but are not limited to: an offset bite, misaligned teeth, slight offset in nose placement (Most noses straighten by one year of age), a tail kink or imperfection or an undescended testicle(s) (which is surgically remedied during the neuter procedure). Breeder has disclosed to Adopter any faults that are currently known and present in the kitten and said faults shall be referenced in the contract.

 

  1. Breeder warrants that the above-described kitten is progeny of animals referenced above as sire and dam and they are healthy and shows no sign illness or congenital defects. A congenital defect is more commonly referred to as a birth defect and most are present at or near birth.  Breeder guarantees the above-described kitten against life threatening congenital defects for two (2) years from the date of birth of the kitten.  This is a limited guarantee and the Breeder must be notified when the congenital defect is first detected.  This guarantee expires when the kitten reaches the age of two (2) years. Congenital defects are limited to the following: life threatening cardiomyopathy, degeneration of the retina, (IF not caused by a lack of taurine in their diet as a kitten), Megaesophagus, portosystemic shunt (liver), Patent ductus arteriosus (PDA), seborrhea oleosa, amyloidosis, and mucopolysaccharidosis.  If a claim for any of the above-referenced congenital defects is made, written verification from a licensed veterinarian must be provided to Breeder with a description of the kitten's congenital defect and their opinion as to seriousness of the defect.  Breeder reserves the right to have the kitten reexamined (at breeder’s expense) by a veterinarian of their choice for confirmation of the defect before replacing the kitten. In this event, the kitten will be replaced with a comparable replacement when one becomes available. Comparable replacement will be like sex and color. Adopter shall be solely responsible for all transportation related expenses. The kitten described in this contract does not have to be deceased for Adopter to make a claim for congenital defect and receive a replacement kitten. In the event the kitten qualifies for replacement under the two-year health guarantee, the kitten does not need to be returned to the breeder. We feel that the kitten becomes part of your family and we will not ask for the kitten to be returned. However, if the kitten is euthanized prior to consulting with the breeder of the disease or illness, a necropsy must be performed to confirm cause of death or reason for euthanasia and the results of necropsy must be provided in writing to the breeder. Under no circumstances will the breeder be obligated to the adopter for a cash refund, the cost of the necropsy or veterinarian costs.

 

  1. Adopter agrees that they are not acting as an agent in the adoption of this kitten and the kitten will reside at the home of the Adopter. This kitten shall never be allowed outdoors. These cats lack the self-defense skills to protect themselves from other animals, including and especially birds of prey. The Adopter agrees to provide necessary vaccinations, annual veterinary check-ups, grooming, health care including proper oral care for the life of this kitten.

 

  1. Other than what is specifically set forth in Paragraph 1, Paragraph 2, Paragraph 3, Paragraph 4, and Paragraph 5 in no circumstances will the Breeder refund or give any monies to Adopter because of forfeiture of kitten, genetic problems (other than described above in paragraph 6), veterinarian costs, human family members developing allergies, inability to integrate kitten into the home with other animals, issues with landlords and their pet acceptance policy or death of kitten.

 

  1. If for any reason, Adopter is unable to keep this kitten, Breeder shall be given the first right of refusal. At the sole expense of Adopter, the kitten shall be returned to Breeder's possession and control, and Adopter shall execute all necessary documents to transfer ownership back to Breeder including transferring of microchip if applicable, CFA registration documents, all veterinary records as well as vaccination records.

 

REMEDIES:

 

Cumulative.  All of Breeder's rights hereunder are separate and cumulative, and no one of them, whether or not exercised, shall be deemed to be an exclusion of any of the other rights and shall not limit or prejudice any legal or equitable right which Breeder may have.

Breeder's Right to Injunction.   In the event of a breach by Adopter of the duties provided in Paragraphs 1, 2, 3, 4, 5, 6, and 7, above, it is understood that Breeder's reputation as a breeder of Persian kittens will be irreparably harmed thereby and that Breeder has no adequate remedy at law.  Breeder shall, therefore, have the right to bring an action in equity and to enjoin Adopter from engaging in the continuation of such practices or actions and also to recover reasonable attorney fees and costs of suit incurred in that action.

ADDITIONAL AGREEMENTS: None. THIS CONTRACT IS MADE AND SIGNED BY BOTH PARTIES TO ENSURE THE WELL-BEING AND PROTECTION OF THIS KITTEN. NO OTHER WARRANTY, VERBAL OR WRITTEN, IS IMPLIED.  THIS AGREEMENT SHALL BE GOVERNED BY AND SHALL BE CONSTRUED IN ACCORDANCE WITH THE LAW OF THE STATE OF COLORADO AND ANY LEGAL ACTION MUST BE BROUGHT IN THE COUNTY OF WELD, STATE OF COLORADO.  ADOPTER WILL BE RESPONSIBLE FOR ALL COURT COSTS INVOLVED DUE TO BREACH OF CONTRACT.

DNA Testing:  Kitten’s parents have been DNA tested by Wisdom Panel via an oral swab sample DNA test results are released with the kitten at time of release. Parents and their offspring are negative for the genes that carry PKD (Polycystic Kidney Disease) and PRA (Progressive Retinal Atrophy), PKDef (Pyruvate Kinase Deficiency) as well as HCM (Hypertrophic Cardiomyopathy).

Pet Insurance:  We recommended that the adopter obtain pet insurance for said kitten. Trupanion Offers a “Go Home Day Offer” for your kitten. They provide immediate coverage  for one month of free pet insurance with no obligation to continue beyond their free coverage. Breeder will provide

information on this program in the “Kitten Kit” packet that is released with the kitten.

Well Baby Exam & Vaccinations:  Prior to release, this kitten will have had its well-baby examination,  age-appropriate deworming and vaccinations at eight and twelve weeks of age. Complete vaccination history shall be provided in the kitten packet which is given with the release of kitten.


Microchipping:
  Adopter may elect to have the breeder microchip said kitten for an additional $45.  This includes lifetime registration of the microchip with BuddyID.
